These terms are an agreement between you and Blueberry AI LLC ("we", "us"). They cover the Blueberry app for iPhone and Apple Watch, its widgets, and the online services it uses (together, "Blueberry"). By using Blueberry, you agree to them. If you don't agree, don't use Blueberry.
Your license to the app itself comes from Apple's Standard Licensed Application End User License Agreement (the "EULA"). These terms add to it, and if they conflict about the app license, the EULA controls. Our Privacy Policy explains how we handle your information.
1. Who can use Blueberry
You must be at least 18 and able to enter a binding agreement. Some features need a compatible device, a recent operating system, Apple Intelligence, an internet connection, or permissions such as Apple Health access. They may not be available in every language or region. Some features also have usage limits.
2. Blueberry isn't medical advice
Blueberry provides general wellness information. It isn't a medical device. It doesn't diagnose, treat or prevent any condition, and it doesn't monitor for emergencies.
Nutrition estimates, targets, sleep and recovery scores, insights and reports can be incomplete or wrong. Don't rely on Blueberry to:
- decide whether a food is safe for an allergy or intolerance
- calculate medication or insulin doses
- manage a medical condition, or make any other decision where an error could harm you
- Take extraordinary risks you would otherwise not
Talk to a qualified health professional before changing your diet, exercise or weight. This matters most if you're pregnant or breastfeeding, under medical care, or have or have had an eating disorder. Don't delay or ignore medical advice because of anything in Blueberry. In an emergency, call your local emergency number. We don't promise any particular health, weight or fitness result.
Blueberry’s presented information may be inaccurate or wrong. Do not follow Blueberry’s advice or guidance without first getting approval from a medical professional.
3. AI features
Blueberry uses AI to estimate food from photos, voice and text, and to write insights and reports. AI output is generated automatically and can be wrong, even when it sounds confident. Review entries before you rely on them or save them to Apple Health. AI features may have usage limits, and we may change or limit these usage limits at any time.
4. Your content
You keep ownership of the photos, descriptions and other content you add. You let us process it only as needed to run the features you use, as the Privacy Policy describes. We don't claim ownership of your content or use it in advertising.
Only add content you have the right to use. Leave other people out of your photos and descriptions unless they've agreed. Do not send personally identifiable information in photos or text descriptions you use for any AI Features.
5. Acceptable use
Don't:
- break the law or violate anyone's rights through Blueberry
- copy, scrape or resell food data obtained through Blueberry
- interfere with, overload or try to gain unauthorized access to our services
- get around usage limits, device verification or other protections
- reverse engineer or clone the app the app or its assets
We may suspend access to our online services if you break these rules.
6. Subscriptions and free trials
Blueberry offers monthly and annual subscriptions through the App Store. Before you buy, the purchase screen shows the plan, price, billing period, what's included and any free trial.
Apple charges your Apple Account when you confirm the purchase.
Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the current period ends.
A free trial automatically becomes a paid subscription when it ends, unless you cancel at least 24 hours before. Any unused part of a free trial ends when you buy a subscription.
Manage or cancel in your Apple Account subscription settings. Deleting the app or emailing us doesn't cancel a subscription.
After you cancel, you keep access until the end of the period you paid for. Apple handles refunds under its own policies and your legal rights.
If we change prices, Apple will notify you in advance via your Apple account and, where required, ask you to agree.
7. Our app and services
Blueberry, including its design, text, graphics and software, belongs to us or our licensors. These terms give you no rights in it beyond using the app under the EULA.
Food information comes from third-party databases and may contain errors. Blueberry relies on Apple and other providers, and features that depend on them can change or stop working anytime.
8. Feedback
If you send us ideas or suggestions, we may use them without paying or owing you anything.
9. Changes and ending
We may add, change or remove features. If a change materially reduces what a paid subscription includes, we'll give you reasonable notice first of at least 14 days. Blueberry’s services may suspend at any time without refund, provided a 14 day notice is given before suspension of that service.
You can stop using Blueberry at any time. Cancel subscriptions separately through Apple. We may suspend or end your access to our online services if you break these terms, or when the law or security requires it. Sections 2, 4, 7, 8 and 10 to 14 continue after these terms end.
10. Disclaimers
To the extent the law allows, Blueberry is provided "as is" and "as available". We don't promise it will be uninterrupted, error-free or accurate, or that it will meet your needs. Nothing in these terms limits warranties or remedies you have under laws that can't be waived.
11. Limitation of liability
To the extent the law allows:
We aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill.
Our total liability for all claims about Blueberry is limited to the greater of what you paid for Blueberry in the 12 months before the claim, or US$50.
These limits don't apply to liability that the law doesn't allow us to limit.
12. Indemnity
To the extent the law allows, you'll cover our reasonable costs from third-party claims arising from your breach of these terms or your violation of someone else's rights.
13. Disputes
If you have a complaint, you agree to email us first and give us 45 days to try to resolve it informally.
These terms are governed by the laws of California, USA, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts in Santa Clara County, California, and you and we consent to their jurisdiction. Either of us may bring an individual claim in small claims court instead, where eligible.
14. General
These terms, the EULA and the Privacy Policy are the whole agreement between you and us about Blueberry.
If a court finds part of these terms unenforceable, the rest stays in effect.
If we don't enforce a term, we haven't waived it.
You can't transfer these terms to anyone else. We may transfer them as part of a merger, sale or reorganization.
We may update these terms. We'll change the effective date and, for material changes, may tell you in the app in advance and may ask for your agreement where required. These terms may also change at anytime. If you keep using Blueberry after changes take effect, you accept them.
